Abstract
Este estudio analiza como los criterios desarrollados por la Corte Interamericana de Derechos Humanos pueden servir de orientación a los órganos nacionales que ejercen el Poder Público, para que en ejercicio de sus competencias garanticen el debido procedimiento administrativo, el derecho a la defensa y la presunción de inocencia, cuando ejercen la potestad administrativa sancionatoria.
This study analyzes how the criteria developed by the Inter-American Court of Human Rights can serve as guidance to the national organs that exercise the Public Power, so that in exercising their powers they guarantee due administrative procedure, the right to defense and presumption of innocence, when exercising the administrative sanctioning power.
