El Strike & Rank como salida a los conflictos de interés de los árbitros

Abstract

The Strike Rank system is a method for appointing arbitrators that involves the submission of a list of potential candidates by the arbitral institution to the parties. The parties are then tasked with ranking and striking candidates based on their preferences for the administration of their arbitration. Ultimately, taking into account the preferences expressed by both parties, the institution itself makes a reasonable decision regarding the arbitrators who will preside over the arbitration. Through this system, any potential conflict of interest between the arbitrators and the parties is mitigated, as the appointed arbitrators are the result of the free and joint selection of both the claimant and the respondent.

El Strike Rank es un sistema de designación de árbitros que consiste en la remisión de una lista de candidatos a ser árbitros por parte del centro arbitral a las partes, con la finalidad de que estas cumplan con clasificar y descartar a los candidatos según su preferencia para la administración de su arbitraje. A la postre, tomando en cuenta las preferencias vertidas por ambas partes, el propio centro decide de manera razonable los árbitros que conducirán el arbitraje. A través de este sistema, el conflicto de interés de los árbitros con las partes se ve diluido, en atención a que los árbitros resultantes son producto de la libre y conjunta elección del demandante y demandado.
