Abstract
El autor analiza la validez de la exigencia legal de pagar una multa administrativa como presupuesto para su revisión administrativa o judicial por parte del recurrente. Para ello, indaga sobre el origen del solve et repete en el derecho tributario, y su traspolación al derecho administrativo sancionador. En este sentido, demuestra que esa obligación legal es incompatible no solamente con la Constitución argentina, sino también con tratados internacionales de derechos humanos que resultan de aplicación en la región. Finalmente, arriba a tal conclusión con independencia de la postura que se adopte sobre la naturaleza jurídica de las multas administrativas.
The author analyzes the validity of the legal requirement to pay an administrative fine as an assumption to be submitted to administrative or judicial review by the appellant. To this end, the author explores the origin of solve et repete in tax law, and its transposition to the administrative penalty law. In this regard, he proves that this legal obligation is incompatible not only with the Argentine Constitution, but also with international human rights treaties in force in the region. Finally, he arrives to such conclusion regardless of the position taken on the legal nature of administrative fines.
