Abstract
El presente artículo aborda el rol técnico que le toca jugar al profesional de la ingeniería en los MARC (Métodos Alternativos de Solución de Controversias). Los MARC, en especial en el tema de la contratación de obras sean estas públicas o privadas, pueden requerir al ingeniero actuar, entre otros, como conciliador (extrajudicial o bajo el modelo FIDIC), mediador, amigable componedor, perito, experto, adjudicador (miembro de un Dispute Board o de una Junta de Resolución de Disputas), o árbitro.
This article discusses the technical role of engineering professionals in ADR (Alternative Dispute Resolution Methods). MARCs, especially in the area of contracting works whether these public or private, may require the Engineer to act, among others, as a conciliator (extrajudicial or under the FIDIC model), mediator, friendly composer, expert, adjudicator (member of a Dispute Board or dispute resolution board), or arbitrator.
