Abstract
El presente trabajo analiza una sentencia del Tribunal Constitucional en materia pesquera donde se declaró inconstitucional la presunción de veracidad relativa a la denuncia formulada por funcionarios de la Administración. El trabajo plantea interrogantes sobre los requisitos del ejercicio de la potestad de inspección y propone la forma de conciliar la presunción de veracidad a favor de la Administración y el derecho al debido proceso de los ciudadanos.
This paper analyses a decision of the Constitutional Court on fishing matters where it was declared unconstitutional the presumption of veracity regarding the complaint made by Administration officials. The paper deals questions about the requirements for the exercise of the power of inspection and it proposes the way to reconcile the presumption of veracity in favor of the Administration and the right to due process of citizens.
