Abstract
El artículo discute el pacto de no demandar en la ley brasileña. Examinando sus orígenes en el pactum de non petendo en el Derecho Romano y en la doctrina clásica y comparada, el autor aborda el debate sobre el objeto, naturaleza y efectos de dicho acuerdo. Asimismo, se pretende identificar la existencia de pactos de no demandar en las disposiciones legales y en la práctica el sistema jurídico brasileño.
The article discusses the covenant not to sue in Brazilian Law. Examining its origins in the pactum de non petendo in Roman Law and in the classic and comparative jurisprudence, the author approaches to the debate on the object, nature and effects of such litigation agreement. Also, it is intended to identify the existence of species of not to sue agreements in in statutory provisions and in judicial practice of the Brazilian legal system.
