Resumen
La responsabilidad de las empresas en materia de seguridad y salud en el trabajo
recaen en un listado de normas que redundan en el deber de prevención de este; sin
embargo, cuando hablamos en estricto de accidentes de trabajo y su tratamiento
normativo y jurisprudencial, son diversas las aristas a analizar, no solo por las tipologías
existentes, sino por los efectos que produce el no contar con elementos propios del
derecho del trabajo para el análisis de cada caso.
En los accidentes de trabajo con muerte sobrevenida se debe explicar cómo se infiere
la responsabilidad del empleador, si es que este siempre responderá o si podrá
excluírsele de la formula. Asimismo, resulta importante analizar el rol que tiene el nexo
causal en este análisis, término utilizado en la responsabilidad civil y que puede ser
aplicado para entender la naturaleza o el tratamiento legal de la muerte de un trabajador
que sobrevenga de un accidente de trabajo.

In particular, when we refer to the death of the worker that occurs from a work accident, it is necessary to explain how the employer's responsibility is inferred, if the latter will always respond or if it can be excluded from the formula. Likewise, it is important to analyze the role of the causal link in this analysis, a term used in civil liability and that can be applied to understand the nature or legal treatment of the death of a worker that occurs from a work accident.
