Resumen
En el presente texto se examinará la importancia de la contribución de la
sentencia Vicky Hernández vs. Honduras en el progreso de la protección de los
derechos humanos de las mujeres trans. Para ello se ha dividido el documento
en dos secciones. La primera se centrará en desarrollar la evolución del concepto
“sexo”, presente dentro de los instrumentos internacionales de derechos
humanos, hacia el concepto “género”. Dentro de la misma se explica cuáles
fueron los aportes del movimiento feminista y la importancia del mismo para el
desarrollo de los derechos de las mujeres trans, desde luna interpretación
evolutiva de la Convención Belém do Pará. Además, se plantea al
reconocimiento del derecho a la identidad de género como factor primordial para
garantizar el derecho de las mujeres trans a una vida libre de violencia. Siguiendo
esa línea, la segunda sección se centrará en desarrollar la aparición de lo trans
dentro del Sistema Interamericano y desarrollar la violencia de género como una
forma de discriminación que también incluye a las mujeres trans. Asimismo, se
planteará la importancia del análisis desarrollado en la sentencia en lo referente
al reconocimiento de la interpretación evolutiva para las nuevas situaciones
actuales tales como la aparición del concepto “género” en los tratados de
derechos humanos.
In this article, an analysis is presented of the contribution of the Vicky Hernández vs. Honduras judgment to the advancement of the protection of the human rights of trans women. For this purpose, the document has been divided into two sections. The first section will focus on developing the evolution of the concept of “sex”, present within international human rights instruments, towards the concept of “gender”. Within this section, it is explained what were the contributions of the feminist movement and the importance of the same for the development of the rights of trans women, from an evolutionary interpretation of the Belém do Pará Convention. In addition, the recognition of the right to gender identity is proposed as a fundamental factor to guarantee the right of trans women to a life free of violence. Following this line, the second section will focus on developing the appearance of trans within the Inter-American System and developing gender-based violence as a form of discrimination that also includes trans women. Likewise, the importance of the analysis developed in the judgment will be raised in relation to the recognition of evolutionary interpretation for new current situations such as the appearance of the concept of “gender” in human rights treaties.
