Guerra jurisdiccional: La contienda permanente por la competencia entre los jueces y los árbitros

Abstract

Arbitration is a jurisdiction recognized by the Peruvian regulatory system, which arises from the free will of the parties to submit the resolution of any dispute to said jurisdiction, excluding it from ordinary or state jurisdiction. However, reality has shown that this agreement may be disregarded by one of the parties, who may seek to submit the dispute to the judicial system, resulting in two different and mutually exclusive jurisdictions hearing the same dispute. The purpose of this article is to analyze the above-described situation under Peruvian arbitration law, describing the main problems that may arise from such a situation and proposing some solutions to the aforementioned problem.El arbitraje es una jurisdicción reconocida por el sistema normativo peruano —incluso a nivel constitucional—, el cual, surge de la voluntad libre de las partes de someter el conocimiento de alguna controversia a dicho fuero, excluyéndola del fuero ordinario o estatal. Sin embargo, la realidad ha demostrado que dicho pacto puede ser desconocido por alguna de las partes, pretendiendo someter el conocimiento de la controversia al Poder Judicial, ocasionando que dos fueros distintos y excluyentes conozcan una misma controversia. El presente artículo tiene por finalidad analizar el supuesto anteriormente descrito en virtud de la Ley de Arbitraje Peruana, describiendo los principales inconvenientes que se pueden ocasionar por dicha situación, así como proponer algunas soluciones a la mencionada problemática.
