Abstract
Señala que la Ley General de Instituciones Bancarias, Financieras y de Desarrollo, Decreto Legislativo N° 637, promulgada por el gobierno de Fujimori, es más que un simple re-ordenamiento y modificación de la legislación existente; es una reforma de las relaciones entre el sector financiero y los agentes económicos.Se cuestiona que se esté legislando sobre normas existentes en leyes orgánicas, tales como el Código Civil, el Código de Procedimientos Civiles, el Código Penal, la Ley de Títulos-Valores, la Ley de Quiebras e incluso, la Ley de Alquileres. Se discute sobre su significado, puesto que está fragmentando peligrosamente la estructura socio-económica del país al otorgarle facultades a la Superintendencia que antes competían al BCR.
The new Banking, Financial and Development Institutions Act enacted by the Fujimori administration through legislative decree N° 637 is more than a simple reorganization and amendment to existing laws, posits the author. It actually changes the relationships between the financial sector and economic agents. Organic laws such as the Civil Code, the Civil Procedures Code, the Criminal Code, the Securities and Stock Exchanges Law, the Bankruptcy Law and even the Rentals Law are challenged. The paper questions their intent as these new laws dangerously disrupt the nation’s socioeconomic structure by giving the banking and insurance companies regulator (SBS) powers that previously were wielded by the Central Reserve Bank.
