Inconstitucionalidad del impuesto a la renta sobre el justiprecio de las expropiaciones

La potestad expropiatoria del estado contenida en el artículo 70° de la Constitución permite el sacrificio de la propiedad por razones de seguridad nacional o necesidad pública a cambio de una indemnización justipreciada, la cual constituye una garantía constitucional que asegura la indemnidad patrimonial del expropiado. No obstante a ello, son reiterativos los errores de la superintendencia de administración tributaria (sUNat) al gravar con el impuesto a la renta el justiprecio recibido por la expropiación, frente a ello, el autor defiende su inafectación desde el punto de vista constitucional a decir del reciente fallo del tribunal Constitucional contenido en el expediente No. 319-2013-aa.
