Los nuevos métodos implementados por el Sistema de Inspección de Trabajo durante la pandemia: Análisis sobre su permanencia en el tiempo

Abstract

El presente trabajo académico pretende analizar brevemente los métodos implementados por el Sistema Inspectivo Laboral durante la pandemia por COVID19. La primera parte aborda los nuevos sistemas y modalidades electrónicas y remotas utilizados en las cuatro modalidades de actuaciones inspectivas; así como las materias de atención prioritarias y complejas establecidas por la Autoridad Inspectiva durante el estado de emergencia. Identificados los cambios en las modalidades de la fase de actuaciones inspectivas, en la segunda parte se contrasta con la data actualizada de la Superintendencia Nacional de Fiscalización Laboral (SUNAFIL) lo que representan estos cambios en la eficacia de la actuación inspectiva y las principales limitaciones que se han suscitado por la falta de presencialidad y el proceso de adaptabilidad; y finalmente, en la ultima parte se analizan los métodos que deberían permanecer en el tiempo, exponiendo las razones y posibles cambios en sus alcances y configuración para una mejor adaptabilidad; toda vez que es de suma importancia la eficacia del Sistema Inspectivo en la búsqueda del cumplimiento de las normas sociolaborales y de seguridad y salud en el trabajo, la promoción del trabajo decente y la erradicación de la informalidad laboral.

This academic work aims to briefly analyze the methods implemented by the Labor Inspectorate System during the COVID19 pandemic. The first part deals with the new electronic and remote systems and modalities used in the four modalities of inspection actions; as well as the priority and complex matters of attention established by the Inspecting Authority during the state of emergency. Once the changes in the modalities of the inspection action phase have been identified, the second part contrasts with the updated data of the National Superintendence of Labor Inspection (SUNAFIL) what these changes represent in the effectiveness of the inspection action and the main limitations that They have arisen due to the lack of presence and the adaptability process; and finally, in the last part, the methods that should remain over time are analyzed, exposing the reasons and possible changes in their scope and configuration for better adaptability; Since it is of utmost importance the effectiveness of the Inspection System in the search for compliance with socio-labor and occupational safety and health standards, the promotion of decent work and the eradication of labor informality.
