Extinción del contrato de trabajo de los empleados del hogar en España

Abstract

The Royal Decree 1629/2011 approaches the special employment relationship of the domestic employees to the common labor normative. However, the regulation of the extinction of employment relationship has kept the the fundamental lines its precedent. The author of this paper seeks to analyze the extinction of the employment contract of household workers in disciplinary dismissal and withdrawal; examining judicial rulings, legal literature and the current state of the subject.En España, el Real Decreto 1620/2011 ha supuesto un acercamiento del empleo doméstico al régimen laboral común. Sin embargo, esto no sucedió con la extinción laboral que siguió las líneas comunes de su precedente. La autora busca en este artículo analizar la extinción del contrato de trabajo de los empleados del hogar en el despido disciplinario y el desistimiento, a través del análisis de la jurisprudencia, doctrina y situación actual.
