Abstract
En este ensayo, el autor analiza los límites que el Tribunal Constitucional peruano posee para ejercitar su poder de declarar que una norma viola la Constitución, así como asegurar que sus decisiones tengan efecto retroactivo y anulatorios. También evalúa la posibilidad de invalidar procesos administrativos y judiciales que aplicaron la ley inconstitucional pero que aún están en trámite, así como los límites que deben existir para dicha revisión.
In this essay, the author analyzes the boundaries that the Peruvian Consti-tutional Court possesses in order to exercise its power to rule as unconstitutional a legal statute, as well as ensure that their decisions had retroactive and nullity effects. Also, the author evaluates the possibility of override administrative and judicial procedures that applied the unconstitutional statute even if they are under way, and the limits that must exist for this decision.
