Las áreas destinadas a la protección del Patrimonio Cultural en el Perú: En torno a la regulación de las excepciones a la intangibilidad en las Áreas Restringidas a la actividad minera

Abstract

A través del presente artículo se analiza la regulación de las excepciones de las áreas restringidas a la minería. Así, la normativa sustenta la necesidad de no frenar la actividad administrativa de fomento de la actividad económica minera a través de una afectación proporcional del Patrimonio Cultural. Esta afectación proporcional se manifiesta a través del establecimiento de excepciones a la intangibilidad de Áreas Restringidas. De esta manera, se examina la falta de regulación procedimental de estas excepciones, y cómo podrían estas afectar la protección del Patrimonio Cultural.This article analyzes the regulation of exceptions of restricted areas for mining. The regulation supports the need of not restraining the administrative activity that foment the mining as an economic activity through a proportional affectation of the Cultural Heritage. This proportional affectation is manifested through the establishment of exceptions to the intangibility of restricted areas. In this sense, the article examines the lack of procedural regulation of these exceptions, and how they could affect the protection of the Cultural Heritage.
