Avances y Desafíos en la Fiscalización Ambiental de Títulos Habilitantes otorgados por el SERNANP

Abstract

En el presente artículo la autora presenta la regulación aplicable al otorgamiento de derechos de aprovechamiento sostenible de recursos naturales en Áreas Naturales Protegidas (ANP) por parte del Servicio Nacional de Áreas Naturales Protegidas por el Estado (SERNANP), con énfasis en lo relacionado a la fiscalización ambiental aplicable a la verificación del cumplimiento de las condiciones establecidas en dichos títulos. Asimismo, se señala la necesidad del desarrollo de un marco normativo pendiente que regule las consecuencias derivadas del incumplimiento de tales condiciones.In this article, the author presents the regulation applicable for granting rights over the sustainable exploitation of natural resources in Natural Protected Areas (ANP) by the National Service of Natural Protected Areas (SERNANP), emphasizing the environmental enforcement related to compliance monitoring of the legal conditions established in those rights. Furthermore, this article points out the need of developing legal regulations in regarding of the consequences related to the noncompliance of those conditions.
