Pautas para la aplicación del principio de fe pública registral

Abstract

El crecimiento económico de los últimos años ha aumentado el número de transferencias inmobiliarias y, por tanto, la necesidad de mayor seguridad jurídica. Una herramienta fundamental para la seguridad jurídica es el Principio de Fe Pública Registral. El presente artículo pretende exponer el concepto y naturaleza jurídica de este principio, así como señalar sus principales características. De este modo, se analizan los requisitos para la aplicación de la Fe Pública Registral, haciendo énfasis en la importancia de la buena fe y sus alcances prácticos. Finalmente, los autores ensayan una respuesta para el caso de duplicidad de partidas y si este problema puede resolverse a través de los principios registrales. Over the past few years economic development has increased the great amount of real estate transfers and, therefore the need for Legal security. One main tool for Legal security is Principle of Public Faith in Registration. This legal article describes this principle and its juridical concept as well as outlining its principal characteristics. For that purpose, it has been analyzed the requisites for the application of Principle of Public Faith in Registration, highlighting the importance of Good Faith and its legal extend. Finally, authors provide a final solution in the duplicity certificates terms. In addition, whether it is able to find an answer thought principles in Registration.
