Saneamiento procesal y fijación de puntos controvertidos para la adecuada conducción del proceso

Abstract

El presente artículo aborda el tema de la fijación de los puntos controvertidos durante la etapa Postulatoria, los cuales a juicio del autor permitirán definir los lineamientos del proceso y concretamente la posterior etapa Probatoria. Para lograrlo, el autor sostiene que es necesario un correcto saneamiento del proceso, interpretando las pretensiones y contrapretensiones de las partes con el fin de determinar si hay un conflicto de intereses que genere incertidumbre jurídica. De esta forma, el juez se aleja de particularidades que no forman parte del fondo de la litis. This article addresses the issue of fixing controversial points during the stage of pleadings, which allow defining the process guidelines and specifically the subsequent Evidentiary Stage. to achieve this, the author submits that it is necessary to a proper sanitation of the process, by interpreting the claims and counterclaims of the parties in order to determine whether there is a conflict of interest that generates legal uncertainty. In this way, the judge is far from particularities that are not part of the background of the dispute.
