Corsiericorsi de los derechos fundamentales en el Perú

Abstract

En el presente artículo, el autor desarrolla y cuestiona el tratamiento jurisprudencial de los derechos fundamentales en escenarios de tensión social y política. Para ello, expone casos emblemáticos en los que el tribunal Constitucional o la Corte suprema han fallado, al parecer, influenciados por el escenario político. Finaliza haciendo una breve reflexión sobre el poder y cómo este puede terminar dirigiendo el curso de los derechos fundamentales. In this paper, the author explores and then questions the jurisprudential treatment of fundamental rights when social and political tension arises. Then, he explores some examples in which the TC or the CS have ruled, seemingly, influenced by the political scenario. Finally, the author makes a brief reflection on power and how it can conclude driving the path fundamental rights follow.
