La posesión como derecho es la consecuencia jurídica de la posesión como hecho, es decir, la posesión se sustenta en la apariencia de un derecho frente a terceros (conducta posesoria). El fundamento de la posesión en la doctrina difiere, sin embargo, como señala el autor, en nuestro país el Código Civil ha adoptado uno, el cuál debe ser adecuado acorde al tiempo y al sistema registral. La posesión se configura como un sustituto de la prueba de propiedad ante la dificultad que significa acreditar el dominio en cada momento, aunque ilegítimos (no propietarios) se beneficien de ello; por ello la aspiración es perfeccionar la prueba de la propiedad. Es decir, la posesión es ahora sólo la mejor fórmula que existe para resolver el problema de las dificultades probatorias.
