La Verdadera Función del Derecho Procesal Constitucional: El Proceso al servicio de la Tutela Efectiva de la Constitución

¿El Derecho Procesal Constitucional es parte del Derecho Constitucional? ¿Es correcta la noción por la cual en aras de la defensa de la Constitución, las reglas procesales deben estar siempre por debajo a la misma, pudiéndose modificar si es que la defensa de la Constitución lo requiere? Aquellas interrogantes serán resueltas por el autor en el presente artículo, partiendo para ello por una introducción sobre la importancia y evolución de la Tutela de la Constitución en el tiempo, pasando luego a una distinción de conceptos determinante para el autor: el Derecho Procesal Constitucional no es parte del Derecho Constitucional, toda vez que de serlo, dicha afirmación permitirá la comisión de graves violaciones a garantías constitucionales procesales, por ello, en realidad el Derecho Procesal Constitucional, constituye parte del derecho procesal. Para ello, y desarrollando el concepto del proceso, el autor concluirá que la crítica al proceso no es más que una mala concepción de lo que verdaderamente significa el derecho procesal, al entenderlo como un conjunto de garantías que están al servicio del derecho material a través de la garantía de la Tutela Jurisdiccional.
