As a consequence, there's only once chance for convincing the Judge.This article covers the strategy to be followed in this new process, from the strategy itself to the allegations, in order to generate certainty in the judge whom will solve the case.

      Presently, labor audit, also known as labor due diligence, is a very important tool used in theprocess of merges and acquisitions. According to the results obtained, negotiations on the final price of the merge or acquisition will depend on it.In the present article, the author explains the procedure, emphasizing the importance that its correct application might have in any merger or acquisition process, being adetermining factor for the process’ success.

      In recent decades, a series of studies have demonstrated that lawyers present   high suicide, alcoholism and divorce rates, even higher than those corresponding  to other professionals. Law students and lawyers are now ranking highest in all of this statistics.It’s on that basis, and considering that the search for wellness is fundamental for every person’s health, the rapporteurs expose the relation between happiness and legal education nowadays, concluding that it is necessary to reconsider the way in which Lawis taught in today’s world.

      The concept of family call embraces a migratory alternative that allows a foreigner to stay in another country with  his or her spouse. Taking into account Peru’s legal framework, it is possible to ask if a foreigneris able to appeal to the family call if he or she is married to a person of the same sex? Wouldit be legitimate to recognize a foreign law thatallows same sex marriages?In the following paper, the author answers these and other questions, analyzing concepts such as family, public order, collective morality and familiar migratory unit that are acknowledged in our legal system by appealing, furthermore, to the weighting testof principles in collision.

      Constitución, configuración y registro de sindicatos en América Latina: El reino espurio de la ley

      The right of freedom of association, nowadays, is considered a fundamental right of workers. However, and though it has been internationallyrecognized in several   Covenants of the International Labor Organization, it has been a tendency among Latin American governments to limit the exercise of this freedom.In the present article, the author criticizes what he considers to be an excessive regulation of the exercise of the right of freedom of association by workers, present in almost every country in the region. These limitations are manifested through constitutional or legal restrictions to the formation of labor unions, union unity regimes and difficulties for the constitution of labor unions. In that way, he calls for the guarantee of the right of freedom of association for workers in Latin America.

      Nowadays, the extensive development ofTax Law has left no branch of Law to remindout of its  influence, Labor Law not  beingany  exceptions.  In  fact,  some Labor Law institutions such as remuneration and utilitiescan have important tributary consequences.Because of this link, the author, in the present article, makes a tributary analysis of Labor Law, reflecting on aspects related to personnelcosts and their tax implications.

      The term "suitability" is understood as the correspondence between what a consumer expects and what he actually receives. In that sense, to clarify what is meant by "duty of suitability" it is necessary to analyze theconcept of "consumer” as well.However, when it comes to our consumer protection system, can we say it is protecting the reasonable consumer, the average consumer or the negligent consumer? In this regard, what are the implications of opting for the protection of one or the  other?  In this article, the author seeks to answer these questions through an analysis of national jurisprudence regarding consumer protection.

      La flexiseguridad como paradigma de las políticas de empleo en Europa: Revisión crítica

      Employment flexibility and employment stability are concepts that, historically, have been found to be opposite to one another within Labor Law. It is in the middle of this context that Flexisecurity is born, being a concept that unifies the two notions with theaim of protecting both sides of the employment relationship: The employer and the employee.The authors undertake a critical review of the concept of flexisecurity based on the definition established by multinational organisms, especially the Community institutions of the European Union. To do so, they take off from the concept of “flexisecurity” and the different opinions it has raised within the Community level, always taking into account the common flexisecurity principles as they have be endeveloped by the European Commission.

      Límites al contenido de la negociación colectiva impuestos por el Estado a sus trabajadores

      Collective bargaining is one of the most important manifestations of the right   to freedom of association, because it serves as the mean through which unions can, progressively, improve labor conditions. It is because of its importance that the contentof this right cannot find itself limited in the possibility for employees  to negotiate their own remuneration, which is what is happening with public employees in our country.In this article, the author makes an analysis of the content of the right of collective bargaining and its limitations imposed by our regulation, from the perspective  of various national and international bodies. Those limitations would be unconstitutional, for they are restraining part of the essential content of the right of collective bargaining, existing, moreover, more suitable measures to achieve the balance between this right and public budget needs.

      In order for labor rights to be recognized as fundamental in the Social and Democratic State of Law, Labor Law had to go through a process of constitutionalization, providing protection to all workers. However, for reasons of historical discrimination, a group of peopleis subject to “special protection” in the contextof labor relations: Working mothers.In this paper, the author presents a complete analysis of the fundamental rights of women in labor relations, stating the reasons for which corresponds to provide “special protection” to women in general, but in particular to working mothers.
