Abstract
El presente caso plantea el problema de determinar si el despido que realiza
INDECO S.A al ex trabajador Juan Mendoza por las causales a) y f) del artículo
25 de la LPCL es válido. Esto implica determinar si es que obedece a una sanción
proporcional y razonable por el incumplimiento e inobservancia de obligaciones
laborales en Seguridad y Salud en el Trabajo y por el faltamiento de palabra en
agravio de un compañero dentro del centro de trabajo.
Para dicho análisis, se ha realizado una revisión del material probatorio, así como
la normativa en materia de Seguridad y Salud en el Trabajo nacional e
internacional, doctrina especializada y jurisprudencia. Específicamente, se
evaluará la existencia de una situación de riesgo que no fue reportada (estar
dentro de la máquina bunchadora), así como se evaluará la existencia o no de
un faltamiento de palabra gestual, para lo que se analizarán sus elementos
objetivos y subjetivos.
Se concluirá que INDECO sí sancionó con razones suficientes y de forma
proporcional al ex trabajador Juan Mendoza, ya que incumplió normativa laboral
de SST. Sin embargo, en el caso del faltamiento de palabra en la modalidad
gestual, concurre el elemento objetivo, más no el subjetivo, por lo que se debe
desestimar para ser causal de despido.
The present case raises the problem of determining whether the dismissal by INDECO S.A of the former worker Juan Mendoza for reasons a) and f) of article 25 of the LPCL is valid. This involves determining whether it is due to a proportional and reasonable sanction for non-compliance and non-observance of labor obligations in Safety and Health at Work and for the gestural insult to the detriment of a colleague within the workplace. For this analysis, a review of the evidentiary material has been carried out, as well as the national and international regulations on Safety and Health at Work, specialized doctrine and jurisprudence. Specifically, the existence of a risk situation that was not reported will be evaluated (being inside the bunching machine), as well as the existence of a gestural grievance will be evaluated, for which its objective and subjective elements will be analyzed. It will be concluded that INDECO did sanction the former worker Juan Mendoza with sufficient reasons and proportionally, since he failed to comply with OSH labor regulations. However, in the case of gestural grievance, the objective element is present, but not the subjective one, so it must be rejected to be grounds for dismissal.
