La fiscalización ambiental en el Perú: situación actual y retos para su efectividad

Abstract
En el presente artículo, los autores explican las disposiciones normativas aprobadas por el OEFA para cumplir con adecuarse a las modificaciones de la LPAG. Asimismo, analizan los retos que tienen a su cargo las Entidades de Fiscalización Ambiental (EFA) a raíz de la aprobación del Decreto Legislativo 1389 que fortalece el Sinefa. Además, reflexionan sobre la necesidad de contar con un régimen de responsabilidad ambiental que permita que las medidas correctivas se dicten de manera oportuna, y con independencia del procedimiento sancionador. Finalmente, proponen contar con un sistema de seguros ambientales obligatorios que asegure la reparación efectiva de los daños ambientales ocasionados por actividades que, por su naturaleza, sean consideradas altamente riesgosas para el ambiente.
In this article, the authors explain the regulatory provisions approved by the OEFA to comply with the modifications to the LPAG. Likewise, they analyze the challenges that are in charge of the Environmental Inspection Entities (EFA) following the approval of Legislative Decree 1389 that strengthens the Sinefa. In addition, they reflect on the need for an environmental responsibility regime that allows corrective measures to be issued in a timely manner, and regardless of the sanctioning procedure. Finally, they propose to have a mandatory environmental insurance system that ensures the effective repair of environmental damages caused by activities that, by their nature, are considered highly risky for the environment.
