Abstract
En el presente Informe se analizará el Caso Álvaro Linares Cano, expuesta mediante
Sentencia del Pleno del Tribunal Constitucional, la cual recae en el expediente 01004-
2021-HC. Esta sentencia declara fundado el recurso de hábeas corpus y ordena poner fin
a la privación de libertad de una persona con discapacidad mental. La Convención sobre
los Derechos de las Personas con Discapacidad, será la norma que orientará este informe,
asimismo la normativa interna vigente en los hechos del proceso tales como la Ley N.º
29973, Ley General de la Persona con Discapacidad, Ley N° 30947, Ley de Salud Mental
y el Decreto Legislativo N° 1384.
Como conclusión consideramos que se constituye el internamiento involuntario de Álvaro
Linares Cano. Por esta razón, se contradice el aparato normativo de rango constitucional,
por lo tanto, el internamiento de Álvaro es ilegal. A su vez, se concluye que se vulneraron
los derechos a la libertad y la salud de una persona con discapacidad mental.
Consideramos que los derechos de las personas con discapacidad mental deben empezar
a ser analizados y garantizados íntegramente a través de la concepción del Modelo Social
de la Discapacidad.
This report will analyze the case of Álvaro Linares Cano, exposed through the settlement of the Plenary of the Constitutional Court, which falls on the file 01004-2021-HC. This aforementioned settlement declares the writ of habeas corpus founded and orders the cessation to the deprivation of liberty of a person with mental disabilities. The Convention on the Rights of Persons with Disabilities will be the norm considered to develop this report, as well as the internal regulations in force at the facts of the process such as Law No. 29973, General Law of Persons with Disabilities, Law No. 30947, Mental Health Law and Legislative Decree No. 1384. In conclusion, we consider that the involuntary internment of Álvaro Martín Linares Cano has been constituted. If so, the normative apparatus of constitutional rank is contradicted, therefore the internment of Álvaro Linares Cano is illegal. In turn, it is concluded that the rights to liberty and health of a person with mental disabilities were violated. We believe that the rights of people with mental disabilities must begin to be fully analyzed and guaranteed through the conception of the Social Model of Disability.
