Resumen
El trabajo propone una visión más amplia en relación con el tratamiento
constitucional del derecho a conocer los cargos dentro del proceso penal, en
específico, en la etapa de investigación preparatoria. Este derecho exige a las
autoridades estatales no solo la precisión clara y detallada de los hechos
denunciados, sino que además obliga a estos a comunicar también de forma
clara, precisa y detallada la norma penal aplicable al caso y la evidencia que
sustenta la imputación, desde el inicio de la investigación preparatoria y en
distintos niveles de exigencia. Por ello, la investigación centra sus esfuerzos en
identificar el contenido esencial y constitucional del derecho a conocer los
cargos, para luego precisar, según sus niveles de exigencia constitucional,
cuáles serían los supuestos de afectación de dicho derecho en las sub etapas
de investigación preliminar e investigación preparatoria propiamente dicha. Para
poder determinar lo antes señalado el trabajo desarrolla los alcances jurídicos y
dogmáticos del derecho a conocer los cargos, para lo cual se recurre al marco
internacional y nacional sobre la materia, así como a la doctrina especializada
(constitucional y procesal penal) que sobre el tema se ha elaborado.
The work proposes a broader vision in relation to the constitutional treatment of the right to know the charges within the criminal process, specifically, in the preparatory investigation stage. This right demands the state authorities not only the clear and detailed precision of the facts denounced, but also obliges them to communicate clearly, precisely and in detail the criminal law applicable to the case and the evidence that supports the imputation circumstantial support on which the charge rests, from the beginning of the preparatory research and at different levels of demand. For this reason, the research focuses its efforts on identifying the essential and constitutional content of the right to know the charges, and then specifying, according to their levels of constitutional demands, what would be the assumptions of affectation of this right in the sub stages of preliminary investigation and preparatory investigation. In order to determine the aforementioned, the work develops the legal and dogmatic scope of the right to know the charges, for which the international and national framework on the matter is used, as well as the specialized doctrine (constitutional and criminal procedure) that has been elaborated on the subject.
