Resumen
La Resolución N° 2977-2023/SPC-INDECOPI aborda la importancia de las
medidas de seguridad que las entidades financieras deben implementar para
proteger las cuentas de los consumidores ante operaciones no reconocidas. En
el caso bajo análisis, Silvia Barrera denunció al Banco Scotiabank por no
adoptar medidas de seguridad adecuadas, lo que permitió 65 operaciones de
compra no reconocidas, por S/ 26,519.00, en su cuenta de ahorros. El
problema principal es determinar si el banco infringió el deber de idoneidad al
no garantizar la seguridad de las operaciones.
El análisis se basa en el Código de Protección y Defensa del Consumidor y el
Reglamento de Tarjetas de Crédito y Débito. La resolución concluye que el
banco no adoptó las medidas de seguridad pertinentes en el rodamiento a la
banca por internet. Los medios probatorios utilizados, como winchas auditoras
y reportes tándem, que no presentó el Banco, hubieran sido los adecuados
sustentar la autorización de las compras.
Finalmente, aunque se concluye que la resolución es correcta, se sugiere que
la Sala Especializada en Protección al Consumidor podría haber realizado un
análisis más detallado del patrón de consumo de la denunciante. Esto destaca
la importancia de un enfoque exhaustivo para garantizar la protección
adecuada de los consumidores financieros y la necesidad de que las entidades
financieras implementen sistemas robustos de prevención de fraude.
Resolution No. 2977-2023/SPC-INDECOPI addresses the importance of the security measures that financial entities must implement to protect consumer accounts against unrecognized operations. In the case under analysis, Silvia Barrera denounced Banco Scotiabank for not adopting adequate security measures, which allowed 65 unrecognized purchase operations, for S/ 26,519.00, in her savings account. The main issue is determining whether the bank breached the duty of suitability by failing to ensure the security of operations. The analysis is based on the Consumer Protection and Defense Code and the Credit and Debit Card Regulations. The resolution concludes that the bank did not adopt the relevant security measures in the implementation of internet banking. The evidentiary means used, such as audit winches and tandem reports, which the Bank did not present, would have been appropriate to support the authorization of the purchases. Finally, although it is concluded that the resolution is correct, it is suggested that the Specialized Consumer Protection Chamber could have carried out a more detailed analysis of the complainant's consumption pattern. This highlights the importance of a comprehensive approach to ensure adequate protection of financial consumers and the need for financial institutions to implement robust fraud prevention systems.
