Resumen
El presente informe jurídico se fundamenta en el caso arbitral N°0265-2017-
CLL de fecha 22 de julio de 2019 en el que se detalla el incumplimiento de la
obligación esencial de entrega oportuna de terrenos de Provías Nacional que
generó un desequilibrio contractual y requirió, por lo tanto, una modificación
contractual. Este caso evidencia la importancia de cumplir oportunamente los
tiempos de entrega de los acordado por la entidad pública para mantener el
equilibrio económico financiero del contrato y las ampliaciones de plazo como
medio para restaurar dicho equilibrio.
La presente investigación, por tanto, se centrará en estudiar las obligaciones de
los contratos administrativos, el equilibrio contractual y las causales de
modificación contractual y las ampliaciones de plazo como alternativa para
mantener el equilibrio económico del contrato administrativo. Tras este
proceso, se plantea que existió incumplimiento de la entrega oportuna de
terrenos, incumpliendo con una obligación esencial para la ejecución del
contrato que llevaría a requerir una modificación contractual para mantener el
equilibrio contractual por lo que, las ampliaciones de plazo eran necesarias.
El caso en mención, se analiza utilizando el Decreto Legislativo N° 1057 Ley de
Arbitraje, la Ley de Contrataciones del Estado, la Ley de Procedimiento
Administrativo general, opiniones del Organismo Supervisor de Contrataciones
del Estado y textos doctrinarios pertinentes.
The present law report is based in the arbitration case N°0265-2017-CLL dated July 22th 2019, which details the breach of the essential obligations of an appropriate timely delivery of the lands by “Provias Nacional”. This resulted in a contractual imbalance that needed a contractual modification. This case puts in evidence the importance of adhering to the delivery timelines agreed upon by the public entity to uphold the financial equilibrium of the contract and the use of deadline extensions as a way to restore that equilibrium. Therefore, this investigation will be focus on the study of the obligations of the administrative contracts, the contractual equilibrium and the grounds for a contractual modification, as well as the use of a deadline extension as an alternative to maintain the financial equilibrium of an administrative contract. Through this review process, it is asserted that there was a failure from the entity side in the timeline of the lands delivery, this constitutes a mayor breach of the essential contract obligation, thereby the request of contract modification to preserve the contract equilibrium and a deadline extension was necessary. This case of study has been analyzed in this inform under the Legislative Decree N. 1057 of the Peruvian Arbitration Law, the Peruvian State Contracting Law, the Peruvian General Administrative Procedure Law, diverse opinions from the Peruvian Supervisory Agency for State Contracting (OSCE) and relevant doctrinal texts.
