Abstract
En el sector privado, es escasa la utilización de la puesta a disposición del cargo
como supuesto de la extinción laboral. La utilización de dicha figura se torna
compleja en la realidad, ante normativa insuficiente y pronunciamientos
judiciales dispersos y escasos.
Sin embargo, los casos en los que se desenvuelve esta discusión representan
oportunidades relevantes para abrir la discusión acerca de las características
entorno a su aplicación, partiendo desde su equiparación, a nivel normativo con
la renuncia, el cuestionamiento acerca de la falta de plazo estipulada para la
aceptación por parte del empleador y la incidencia de los principios del derecho
laboral.
El caso que se desarrollará en el presente informe jurídico nos permite cuestionar
la falta de regulación de la figura en cuestión y adentrarnos en un análisis del
caos concreto, en el que un trabajador pone a disposición su cargo, siendo este
aceptado cuatro (4) meses después, dando como consecuencia la extinción de
la relación laboral. Respecto al plazo, nos permitirá analizar la aplicación de los
principios de razonabilidad y continuidad de la relación laboral, en sintonía con
la propuesta del plazo planteada.
Finalmente, se hará referencia a jurisprudencia, doctrina y normativa
especializada, que nos permitirá brindar respuesta a las preguntas planteadas.
In the private sector, there is little use of the termination of employment as an assumption of termination of employment. However, the cases in which this discussion takes place represent relevant opportunities to open the discussion about the characteristics surrounding its application, starting from its equivalence, at a regulatory level with resignation, and the questioning of the lack of a stipulated term for acceptance by the employer. The case that will be developed in this legal report allows us to question the lack of regulation of the figure in question and enter into an analysis of the concrete chaos, in which a worker makes his position available, being this accepted four (4) months later, resulting in the termination of the employment relationship. Finally, reference will be made to jurisprudence, doctrine and specialized regulations, which will allow us to provide answers to the questions raised.
