Abstract
El presente caso abarca el análisis de la sanción impuesta por el Consejo
Directivo del Osinergmin mediante la Resolución N°131-2010-OS/CD en el
procedimiento administrativo sancionador iniciado contra Southern sucursal Perú
por incumplimiento de normas ambientales y de dos programas de manejo y
adecuación ambiental en la Fundición y Refinería de Cobre – Ilo. Para ello, el
presente trabajo busca analizar si los argumentos con los cuales se impuso la
sanción siguieron la logica conforme a los límites y parámetros establecidos en
el ordenamiento jurídico peruano, la jurisprudencia y la doctrina.
A partir del análisis, se concluye que la ejecución del procedimiento sancionador
vulneró los principios de legalidad, tipicidad, non bis idem, el principio de
veracidad y licitud. Ello, debido a que Osinergmin desconoció los alcances y
límites de los principios antes mencionados, y porque valoró inadecuadamente
las actas de fiscalización que se obtuvieron sobre Southern, las cuales fueron el
sustento principal para imponer la sanción.
This case covers the analysis of the sanction imposed by the OSINERGMIN Board of Directors through Resolution No. 131-2010-OS/CD in the administrative sanctioning procedure initiated against Southern branch Peru for non-compliance with environmental standards and two management programs and Environmental adaptation in the Copper Smelter and Refinery – Ilo. To achieve this, the present work aims to analyze whether the arguments with which the sanction was imposed were exercised in accordance with the limits and parameters established in the Peruvian legal system, jurisprudence and doctrine. Based on the analysis, it is concluded that the execution of the sanctioning procedure violated the principles of legality, typicality, non bis idem, the principle of truthfulness and legality. This occurs because Osinerming did not know the scope and limits of the aforementioned principles, and because it inadequately assessed the inspection reports obtained on Southern, which were the main basis for imposing the sanction.
