El artículo analiza los cambios y continuidades en la rectoría de la institucionalidad ambiental durante los últimos veinte años, desde la creación del Consejo Nacional del Ambiente, en diciembre de 1994, hasta el actual Ministerio del Ambiente, creado en el año 2008, y actualmente en funcionamiento.En el Perú, desde la década de los noventa, hemos visto proceso de cambios paulatinos del marco institucional ambiental2 En dicho contexto, se han creado —y han desaparecido—distintas entidades públicas responsables de la gestión pública ambiental. El hito más importante de este proceso lo representa —qué duda cabe— la creación del Ministerio del Ambiente, en el año 2008. Sin embargo, dicho hecho —y su posterior evolución— no puede comprenderse sin entender su inmediato antecedente: el Consejo Nacional del Ambiente (Conam), que entró en funcionamiento en 1995. Transcurridos veinte años, ¿qué cambios y continuidades podemos identificar entre estas dos entidades públicas, ambas rectoras de la política ambiental nacional?Para responder esta pregunta, presentaré el diseño del Conam; luego, identificaré las principales políticas que se diseñaron durante su funcionamiento. Después, pasaré revista la situación actual de dichas políticas dentro del Minam y las variaciones que pueden identificarse.
This article analyzes the changes and continuities in the rectory of environmental institutionalism over the past twenty years, since the establishment of the National Environment Council, in December 1994, to the current Ministry of Environment, created in 2008, which is nowadays operating.In Peru, since the decade of the nineties, we have seen a process of gradual changes of the environmental institutional framework. In this context, several public entities responsible for environmental public management have been created —and have disappeared—.The most important milestone in this process is —there is no doubt— the creation of the Ministry of the Environment, in the year 2008. However, that fact —and its future evolution— cannot be understood without understanding its immediate predecessor: the National Environmental Council (Conam), which started working in 1995. After twenty years, ¿what changes and continuities can we identify between these two public entities, both governing national environmental policy?For answering this question, we will present the Conam design and then we will identify the main policies that were designed during its operation. After that, we will examine the current situation of those policies inside the Minam and the variations that can be identified.
