VIII pleno casatorio civil: implicancias prácticas en el ámbito registral y en la protección del adquirente de buena fe

Abstract

El 20 de setiembre de 2020, se publicó el VIII Pleno Casatorio Civil. En esta sentencia, la Corte Suprema determinó que el acto jurídico de disposición de bienes de la sociedad conyugal, en el que interviene solo uno de los cónyuges, es nulo. Así, en el presente informe jurídico, se analiza cuáles son las implicancias de la decisión de la Corte Suprema en las partes del acto jurídico, el cónyuge que no intervino y posibles terceros. También se analiza los efectos de la nulidad del acto jurídico en un ámbito registral, lo que implica determinar si hay o no alguna afectación al tercero registral de buena fe. Además, se pretende dar una apreciación propia con respecto a si el acto jurídico de disposición de bienes sociales, efectuado por un solo cónyuge, es nulo, anulable o ineficaz. A partir de este análisis, en base a doctrina y jurisprudencia, se concluye que la tesis de la ineficacia es la más adecuada, no solo porque la ausencia de uno de los cónyuges en el acto constituye una falta de legitimación, sino porque esta tesis cautela los intereses de todos los intervinientes en este acto, incluyendo al cónyuge que no intervino y al comprador de buena fe.On September 20th, 2020, the VIII Pleno Casatorio Civil was published. In this ruling, the Supreme Court determined that the legal act of disposition of assets of the marital partnership, in which only one of the spouses intervenes, is null. Thus, this legal report analyzes the implications of the Supreme Court's decision on the parties of the legal act, the spouse who did not intervene and possible third parties. It also analyzes the effects of the nullity of the legal act in a registry scope, which also implies determining whether or not there is any affectation to the third party who contracts under the parameters established by article 2014 of the Civil Code In addition, it is intended to give its own assessment as to whether the legal act of disposition of matrimonial property, carried out by only one spouse, is null, voidable or ineffective. From this analysis, based on doctrine and jurisprudence, it is concluded that the ineffectiveness thesis is the most appropriate, not only because the absence of one of the spouses in the act constitutes a lack of legal standing, but also because this thesis safeguards the interests of all the participants in this act, including the spouse who did not intervene and the bona fide purchaser
