Resumen
El presente trabajo de investigación parte de una Resolución del Tribunal Registral N°
2401-2020-SUNARP-TR-L, en el que se discute como tema central la adecuación y
modificación del reglamento interno general de una Junta de Propietarios según la Ley
N° 27157, siendo el problema central el quórum y el acuerdo requerido para la
modificación del porcentaje de participación de los propietarios de secciones exclusivas
sobre áreas y bienes comunes, siendo de mucha importancia para cada propietario de
áreas exclusivas para el quórum, voto en las asambleas así como para asumir los gastos
de administración y mantenimiento del edificio.
Este trabajo tiene por objetivo analizar las normas referidas al reglamento interno de
Junta de propietarios del régimen de propiedad exclusiva y propiedad común, teniendo
en cuenta que el reglamento interno es un documento donde se consigna los derechos y
obligaciones de los propietarios, en especial el porcentaje de participación en áreas
comunes, entre otros temas de junta de propietarios.
Se ha tomado en cuenta la Ley No 27157, su reglamento y distintas resoluciones del
Tribunal Registral relacionados a la adecuación del Reglamento Interno de Junta de
Propietarios, el cual es un documento de mucha importancia para la existencia del
régimen de propiedad exclusiva y propiedad común regulado por la Ley N° 27157.
En la adecuación del reglamento interno cuando las reglas establecidas en el reglamento
primigenio difieren a las disposiciones de la Ley N° 27157, éstas reglas deben ser
modificadas, lo cual es objeto de análisis en el presente trabajo de investigación.
This research work is based on the Registry Court Resolution No. 2401-2020-SUNARP-TR-L, which contains issues of civil law as well as registry law. The central legal issue analyzed in Resolution No. 2401-2020-SUNARP-TR-L is the quorum and agreement required to modify the participation percentage of the owners of exclusive sections on areas and common goods. In that sense, the Registry Court discuss the application of the process of adaptation and modification of the Internal Regulations of the Board of Owners, according to the rules established in Law No. 27157. The objective of this research is analyze the applicable law regarding the Internal Regulations of the Board of Owners of the exclusive and common property regime, taking into consideration that the Internal Regulations sets forth the rights and obligations of the owners, especially the percentage participation in common areas, among other issues of the owners meeting. Law No. 27157 has been taken into account, its regulations and different resolutions of the Registry Court related to the adaptation of the Internal Regulations of the Board of Owners, which is a document of great importance for the existence of the regime of exclusive property and regulated common property by Law No. 27157. Considering the entry into force of Law N° 27157, specific modifications in the Internal Regulations are required, which is subject to analysis in this research paper.
