Resumen
El presente Informe Jurídico tiene como finalidad entender la categoría del trabajador de
confianza, siendo que este cargo a la actualidad produce aún incertidumbre entre los
trabajadores, empleadores y genera discusiones académicas en el medio; todo esto usando
como fuente el Expediente N° 05214-2016-PA/TC, referido a la desnaturalización del
contrato de trabajo del Sr. Edgar Raúl Zúñiga Morán.
Es en ese sentido, que el presente documento busca determinar no solo las características
propias de esta categoría según el ordenamiento jurídico peruano, sino también analizar
las vías procesales idóneas con las cuales se puede acceder a una correcta tutela
jurisdiccional efectiva. Asimismo, efectuar una debida diferenciación entre la vía procesal
laboral ordinaria y cuáles son los aspectos que resuelve, así como la necesidad de revisar
algún tema de carácter laboral en el Proceso de Amparo.
Para lograr este objetivo, he efectuado la determinación de los hechos del caso en
conflicto, la selección y análisis de validez e idoneidad del material normativo, así como
la aplicación de este material a los hechos del caso. Finalmente, conforme al criterio de
resolución empleado por el Pleno del Tribunal Constitucional, justificar y criticar
constructivamente la Sentencia.
The purpose of this Legal Report is to understand the category of trusted worker, since this position currently still produces uncertainty among workers, employers and generates academic discussions in the domain of research. We aim to report th File No. 05214-2016-PA / TC involving to the denaturing of Mr. Edgar Raúl Zúñiga Morán's employment contract. It is in this sense that this document aims to achieve the following goal: to determine not only the characteristics of such category according to the Peruvian legal system, but also to analyze the most adequate proceeding for a correct and effective judicial protection to be obtains. Furthermore, we shall individualize the ordinary labor procedural route and what are the aspects that solves, as well as the necessity to review any labor issue in the Amparo Process route [writ of amparo]. To achieve this objective, I have carried out the determination of the facts of the case in conflict, the selection and analysis of the validity and suitability of the statutory rules, as well as the application of such rules to the facts of the case. Finally, according to the resolution criteria used by the Plenary of the Constitutional Court, the legal report brings a justified and critical approach to the Sentence.
