Resumen
El objetivo del presente informe jurídico es analizar la sanción impuesta a Southern Perú por
parte del Consejo Directivo del OSINERGMIN mediante la Resolución N°131-2010-OS/CD;
por haber incurrido en cinco infracciones ambientales relacionadas con el incumplimiento del
PAMA de la Fundición y Refinería de Cobre – Ilo, y por el incumplimiento de dos proyectos
contemplados en dicho PAMA: “Planta de Metales Preciosos y de Selenio”, y “Mejora en la
Zona de Lavado de Carros de Ferrocarril”.
Para ello, se recurre a la revisión de la Constitución, el TUO de la LPAG y las normas que
regulaban el procedimiento sancionador del OSINERGMIN en el momento en que resolvió
sancionar a Southern Perú. Esto se realiza, por supuesto, sin perder de vista las normas
ambientales y de carácter administrativo que resultan aplicables al caso. Además, también se
toma en cuenta la jurisprudencia del Tribunal Constitucional, organismo que dota de contenido
a los principios constitucionales a través de sus sentencias.
A partir del análisis, se advierte que la Resolución de Consejo Directivo N°131-2010-OS/CD
del OSINERGMIN carece de validez por contravenir los principios de legalidad, tipicidad,
debido procedimiento y non bis in ídem. Ellos se encuentran reconocidos tanto en el TUO de
la LPAG como en la Constitución, por lo que dicha resolución no solo resulta contraria a la
ley, sino también a la norma fundamental. Por lo tanto, incurre en la primera y segunda causal
de nulidad del artículo 10 del TUO de la LPAG, siendo nula de pleno derecho.
The aim of this legal report is to analyze the sanction imposed on Southern Peru by the OSINERGMIN Board of Directors through Resolution N°131 -2010-OS/CD; for having incurred in five environmental infractions related to the breach of the PAMA of the Copper Smelter and Refinery – Ilo, and for the breach of two projects contemplated in said PAMA: “Precious Metals and Selenium Plant”, and “Improvement in the Zone Railway Car Wash”. To do this, a review of the Constitution, the LPAG TUO and the rules that regulated the sanctioning procedure of OSINERGMIN at the time it decided to sanction Southern Peru is resorted to. This is done, of course, without losing sight of the environmental and administrative regulations that are applicable to the case. In addition, the jurisprudence of the Constitutional Court is also taken into account, an organism that gives content to the constitutional principles through its sentences. From the analysis, it is perceived that the Resolution of the Board of Directors N°131 -2010- OS/CD of OSINERGMIN is invalid for breaking the principles of legality, typicality, due process and non bis in ídem. They are recognized both in the LPAG TUO and in the Constitution, so the resolution is not only contrary to law, but also to the fundamental norm. Therefore, it incurs in the first and second grounds for nullity of article 10 of the TUO of the LPAG, being void ab initio.
