Abstract
El presente Informe Jurídico analiza el caso de una proveedora que, valiéndose
de su presencia en diversas redes sociales y aplicativos, viene estableciendo
relaciones de consumo, a través de medios virtuales, sin que cumpla con la
obligación de la implementación de un Libro de Reclamaciones Virtual en favor
de los consumidores. Así, se demostrará que, si bien dicha proveedora no cuenta
con una página web propia a través de la cual, usualmente, se adquieren
productos; en la práctica, ello no le significa algún inconveniente a la misma,
puesto que, finalmente, logra concretar sus ventas. Así, se evidenciará como es
que, en el caso de estudio, el comportamiento de la proveedora lesiona el
derecho al reclamo de una consumidora en específico. Este trabajo recurrirá a
la protección especial constitucional otorgada por el Estado peruano sobre los
consumidores, así como a los principios previstos en el Código de Protección y
Defensa del Consumidor, y, a su vez, a los pronunciamientos y recomendaciones
que organismos internacionales han propuesto en orden a la íntegra protección
de los derechos de los consumidores que utilicen el comercio electrónico.
Finalmente, se señalará que la decisión de la Sala fue acertada, sin perjuicio de
advertir, también, que pudieron utilizarse argumentos más elaborados a fin de
robustecer la postura de la Autoridad de Consumo.
This Legal Report analyzes the case of a supplier that, using its presence on various social networks and applications, has been establishing consumer relationships through virtual means, without complying with the obligation to implement a Virtual Complaints Book in favor of consumers. Thus, it will be demonstrated that, although said supplier does not have its own website through which products are usually purchased; In practice, this does not mean any inconvenience to it, since, finally, it manages to make its sales. Thus, it will be evident how, in the case study, the provider's behavior harms the right to claim of a specific consumer. This work will resort to the special constitutional protection granted by the Peruvian State to consumers, as well as the principles provided for in the Consumer Protection and Defense Code, and, in turn, the pronouncements and recommendations that international organizations have proposed in order for the full protection of the rights of consumers who use ecommerce. Finally, it will be pointed out that the Chamber's decision was correct, without prejudice to also noting that more elaborate arguments could have been used in order to strengthen the position of the Consumer Authority.
