Resumen
El presente Informe Jurídico contiene la formulación y el análisis de diferentes
problemas jurídicos suscitados como consecuencia de la Resolución 1197-
2014-SPC. La mencionada resolución trata del procedimiento administrativo
sancionador en materia de Discriminación en el Consumo, iniciado tanto de
oficio como de parte por la Secretaría Técnica de la Comisión de Protección al
Consumidor, y Godfrey Arbulú Grippa, respectivamente; denunciando a la
empresa Gothic Entertainment S.A. – Discoteca Gótica. El motivo de la
denuncia es que -presuntamente- la Discoteca Gótica intentó disuadir a
Godfrey Arbulú Grippa de ingresar al local sin que exista causas objetivas y
justificadas para ello, como aumentarle el precio de la entrada y ponerle trabas
para que termine desistiendo, debido a su condición de transgénero. Luego de
haber realizado una descripción de los hechos, un análisis de tanto los
problemas principales como secundarios, se concluye que sí hubo vulneración
del Código de Protección y Defensa del Consumidor, en materia de
discriminación, además de estar en desacuerdo con la sanción impuesta.
Finalmente, se brindan algunas recomendaciones en relación con las
conclusiones a las que se han llegado.
The following Legal Report contains the formulation and analysis of different legal problems arising as a consequence of Resolution 1197-2014-SPC. The aforementioned resolution covers the administrative sanctioning procedure regarding Discrimination in Consumption, initiated both ex officio and as a party by the Technical Secretariat of the Consumer Protection Commission, and Godfrey Arbulú Grippa, respectively; denouncing the company Gothic Entertainment S.A. - Discoteca Gótica. The reason for the complaint is that - allegedly - Gothic Discotheque tried to dissuade Godfrey Arbulú Grippa from entering the establishment without the existence of objective and justified causes for it, such as increasing the price of the admission fee and making it difficult for him to desist, due to his transgender condition. After having made a description of the facts, an analysis of both the main and secondary problems, it is concluded that there was a violation of the Code of Consumer Protection and Defense, in terms of discrimination, in addition to disagreeing with the sanction imposed. Finally, some recommendations are provided in relation to the reached conclusions.
