Abstract
En este artículo, la autora analiza el Artículo 50-A de la ley de arbitraje peruana (incorporado por el Decreto de Urgencia N° 020-2020), que regula la figura del abandono para los arbitrajes en los que interviene el Estado. A modo de marco teórico, en primer término, se describe el fundamento y la finalidad del abandono desde su origen procesal. Luego, se analizan los problemas prácticos de la actual redacción del Artículo 50-A y las principales críticas a los vacíos de esta norma. Finalmente, se analiza la utilidad o inconveniencia de incorporar una regla sobre abandono a los arbitrajes bajo el régimen de contrataciones del Estado, atendiendo a las reglas previstas en la Ley de Arbitraje, a las características del arbitraje y a las consecuencias de la conclusión de los arbitrajes por abandono.
In this article, the author analyzes Article 50-A of the Peruvian arbitration law (incorporated by the Urgency Decree N° 020-2020), which regulates the discontinuance of the arbitration due to the default of the parties to act –abandonment of the arbitration– in arbitration proceeding in which the State takes part. As a theoretical framework, the author describes the basis and purpose of the abandonment of the proceeding from its procedural origin. Then, the author analyzes the practical problems of the current wording of Article 50-A and the main critics to the voids of this rule. Finally, the author analyzes the usefulness or inconvenience of incorporating a rule on abandonment of the arbitration, under the state contracts regime, in accordance with the regulations of the Peruvian arbitration law, the characteristics of the arbitration and the consequences of the termination of arbitration by abandonment.
