Abstract
El presente trabajo destaca la importancia de proteger a los consumidores
vulnerables, situación que se pudo ver reflejada a especialmente a raíz de la
pandemia del COVID-19, y aboga por la necesidad de legislar al respecto. La
resolución final confirmó que el banco infringió el Código de Protección y Defensa
del Consumidor, pero solo bajo un incumplimiento en su deber de idoneidad,
dejando de lado la desventaja en la que se encontraba la denunciante, al ser
parte de un grupo vulnerable. Se propone así, que se tomen en cuenta las
necesidades de los consumidores vulnerables en las políticas públicas y que se
implemente una normativa más detallada para protegerlos. Por otro lado, se
cuestiona si la sanción impuesta por el órgano resolutorio fue correcta, a fin de
garantizar la protección los derechos de los consumidores vulnerables, y mitigar
prácticas abusivas por parte de los proveedores. Finalmente, se concluirá que a
pesar que la figura del consumidor vulnerable sea mencionada en ciertos textos
normativos peruanos, esta no cuenta con leyes suficientes para protegerlos
eficientemente. Así, se recomiendan medidas para garantizar un acceso
equitativo en el mercado, como tambien una mejor atención al cliente para estos
grupos, mediante una tutela reforzada.
This paper highlights the importance of protecting vulnerable consumers, a situation that was particularly evident, especially in light of the COVID-19 pandemic, and advocates for the need to legislate accordingly. The final resolution confirmed that the bank violated the Consumer Protection and Defense Code, but only in terms of its failure to fulfill its suitability duty, overlooking the disadvantage faced by the complainant as part of a vulnerable group. It is thus proposed that the needs of vulnerable consumers be taken into account in public policies and that more detailed regulations be implemented to protect them. Furthermore, there is a question about whether the sanction imposed by the resolving body was appropriate to ensure the protection of vulnerable consumers' rights and to mitigate abusive practices by providers. Finally, it will be concluded that despite the mention of vulnerable consumers in certain Peruvian regulatory texts, there are not sufficient laws to effectively protect them. Therefore, measures are recommended to ensure equitable market access and improved customer service for these groups through strengthened oversight.
