Resumen
Este artículo académico se adentra en el principio de adecuación social, explorando su
normativa, las posibles infracciones y, sobre todo, los desafíos que estas plantean. Se
examinará la teoría relacionada con la competencia desleal en el ámbito publicitario
como contexto inicial. Posteriormente, se abordará el problema central que gira en torno
a la indeterminación de este principio, y se analizará cómo los jueces resuelven la
cuestión de determinar si una publicidad infringe dicho principio.
El propósito central del artículo será el desafío intrínseco de determinar cuándo y de qué
manera una publicidad lo infringe, dada su naturaleza indeterminable. En este contexto,
nos proponemos resaltar la importancia de establecer precedentes o directrices que
abordan la necesidad de contar con una metodología definida para que las autoridades
puedan llevar a cabo evaluaciones precisas. Estos precedentes y lineamientos deben
enfocarse en la creación de un marco que permita a las autoridades realizar un análisis
exhaustivo y holístico al interpretar el anuncio en cuestión. La ausencia de tales pautas
puede generar interpretaciones dispares y, por ende, resoluciones arbitrarias,
subrayando la urgencia de establecer un enfoque más estructurado y uniforme en la
evaluación de la publicidad respecto al principio de adecuación social.
This academic article delves into the principle of social adequacy, exploring its regulations, potential infringements, and, most importantly, the challenges they pose. The theory related to unfair competition in the advertising field will be examined as an initial context. Subsequently, the central issue surrounding the indeterminacy of this principle will be addressed, and an analysis will be conducted on how judges resolve the question of determining whether an advertisement violates said principle. The central purpose of this report is to address the intrinsic challenge of determining when and how advertising violates the principle of social adequacy, given its indeterminate nature. In this context, we aim to emphasize the importance of establishing precedents or guidelines that address the need for a defined methodology for authorities to conduct precise evaluations. These precedents and guidelines should focus on creating a framework that allows authorities to carry out a thorough and holistic analysis when interpreting the advertisement in question. The absence of such guidelines can lead to disparate interpretations and, consequently, arbitrary resolutions, underscoring the urgency of establishing a more structured and uniform approach in evaluating advertising regarding the principle of social adequacy.
