Resumen
La sostenibilidad en el aprovechamiento de los recursos hídricos se materializa con la
participación en el procedimiento administrativo del titular del predio donde yace el
recurso hídrico.
El objetivo general del trabajo es determinar la necesaria participación del titular del
predio en el procedimiento administrativo de ejecución de estudios de disponibilidad
hídrica, de lo cual hemos concluido que es determinante para la eficiencia de la
normatividad relaciona al aprovechamiento del recurso hídrico, y así evitar conflictos
sociales y judiciales que suspendan paralicen o hagan inviable los proyectos, ello desde
la metodología cualitativa, donde hemos analizado la normatividad especial y general,
esto es la Ley de recursos hídricos y la ley general de procedimiento administrativo, así
como la doctrina nacional y extranjera.
La normatividad ambiental en el aprovechamiento de los recursos hídricos debe ser
medido como instrumento de resolución de problemas y no desde una medición de
cumplimiento como hoy en día se mide la participación del titular del predio en el
procedimiento (la no participación) que a nuestro criterio representa una pieza principal,
antes durante y después en el desarrollo del proyecto, conjuntamente con las
comunidades, esto último reflejado en la participación ciudadana o consulta previa según
corresponda.
Sustainability in the use of water resources is materialized with the participation in the administrative procedure of the owner of the property where the water resource lies. The general objective of the work is to determine the necessary participation of the owner of the property in the administrative procedure for the execution of water availability studies, from which we have concluded that it is decisive for the efficiency of the regulations related to the use of water resources, and thus avoid social and judicial conflicts that suspend or make the projects unviable, this from the qualitative methodology, where we have analyzed the special and general regulations, this is the Law of water resources and the general law of administrative procedure, as well as the national and foreign doctrine. Environmental regulations in the use of water resources must be measured as a problemsolving instrument and not from a measurement of compliance as today the participation of the property owner in the procedure (non-participation) is measured, which in our opinion It represents a main piece, before, during and after, in the development of the project, together with the communities, the latter reflected in citizen participation or prior consultation as appropriate.
