Resumen
En el presente trabajo de investigación se ha buscado analizar la sentencia
dictada por la Corte Interamericana de Derechos Humanos (Corte IDH) en el
caso Beatriz y otros vs. El Salvador. La pregunta principal que se busca
responder es si la negativa del acceso al aborto por parte de El Salvador, en
tanto el embarazo ponía en riesgo la vida de Beatriz y el feto había sido
declarado inviable fuera del vientre materno, ha vulnerado los derechos a la vida,
a la salud, a la integridad, a la vida libre de violencia, a la vida privada y a
las garantías judiciales de Beatriz. A fin de responder dicha pregunta, se han
desarrollado los alcances de los derechos mencionados y su relación con
el aborto como tratamiento médico, teniendo en cuenta distintos
pronunciamientos de la Corte IDH y los comités sobre derechos humanos.
Sobre la base de dicho desarrollo se ha criticado lo resuelto por la Corte
Interamericana de Derechos Humanos en el caso objeto de estudio, debido a
que aquella no determinó en su sentencia el tema central del caso: la
protección del aborto en el sistema interamericano de derechos humanos. Por
parte de la autora, se concluye en el presente informe que sí se han
vulnerado los derecho mencionados, pues efectivamente en el derecho
internacional el acceso al aborto se encuentra protegido.
This research paper seeks to analyse the ruling handed down by the Inter- American Court of Human Rights (IACHR) in the case of Beatriz et al. v. El Salvador. The main question to be answered is whether El Salvador's denial of access to abortion, given that the pregnancy endangered Beatriz's life and the foetus had been declared unviable outside the womb, violated Beatriz's rights to life, to health, to integrity, to be free from violence, to private life, and to judicial guarantees. In order to answer this question, the scope of the aforementioned rights and their relationship to abortion as a medical treatment have been developed, taking into account various statements by the Inter-American Court of Human Rights and human rights committees. On the basis of this analysis, the decision of the Inter-American Court of Human Rights in the case under review has been criticised because it did not address the central issue of the case in its judgment: the protection of abortion in the inter-American human rights system. The author concludes in this report that the aforementioned rights have indeed been violated, since access to abortion is protected under international law.
