Resumen
El sistema de responsabilidad penal de adolescentes de nuestro país ha ido
apostando por un modelo garantista y de corte restaurativo, adoptando con el
paso de los años mecanismos para el cumplimiento de una protección integral
y especializada para los y las adolescentes infractores. Sin embargo, esta
intención ha adolecido sostenidamente de muchas deudas respecto de su
implementación y concreción, siendo una de ellas la escasa rigurosidad en la
justificación de los jueces al momento de imponer una medida socioeducativa
en un contexto en donde el internamiento suele ser la más empleada.
Partiendo de este de escenario, este informe analizará la sentencia recaída en
el Exp. Nº 00804-2013-PHC/TC, un proceso de hábeas corpus en favor del
adolescente N. Y. J. D. por la vulneración del derecho a la motivación de las
resoluciones. Aunque el presente trabajo estará de acuerdo de manera general
con la decisión final del Tribunal, pretende también dar más luces respecto del
impacto del uso de los informes técnicos de los equipos multidisciplinarios en la
motivación de las medidas adoptadas. Para ello, se realizó una investigación
de carácter dogmático, recurriendo a la normativa, jurisprudencia y doctrina
recurrente, así como también datos estadísticos contemporáneos al caso y su
contraste con data más actual. Finalmente, es posible concluir que en nuestro
sistema los procesos penal juveniles, particularmente, merecen más atención
para su seguimiento de acuerdo a los parámetros internacionales en la materia,
el cual exige tanto la especialidad de los jueces como de todos los funcionarios
involucrados
The criminal responsibility system for adolescents in our country has been betting on a guarantee and restorative model, adopting over the years mechanisms to comply with comprehensive and specialized protection for adolescent offenders. However, this intention has consistently suffered from many debts regarding its implementation and concretion, one of them being the lack of rigor in the justification of the judges when imposing a socio-educational measure in a context where internment is usually the most used. Starting from this scenario, this report will analyze the sentence handed down in File No. 00804-2013-PHC/TC, a habeas corpus process in favor of the adolescent N.Y.J.D. for the violation of the right to due motivation of resolutions. Although this paper will be in general agreement with the Court's final decision, it also aims to shed more light on the impact of the use of the technical reports from the multidisciplinary teams on the motivation for the measures adopted. For this, a dogmatic investigation was carried out, resorting to the regulations, jurisprudence and relevant doctrine, as well as contemporary statistical data to the case and its contrast with more current data. Finally, it is possible to conclude that in our system juvenile criminal proceedings, particularly, deserve more attention for their follow-up according to international parameters on the matter, which requires both the specialty of the judges and of all the officials involved
