Resumen
En el presente informe jurídico se analizará la Resolución N° 3206-2023/SPCINDECOPI, en la cual se resuelve la denuncia realizada por la señora Elizabeth
Magaly D’Uniam Paredes en contra de la Asociación Cultural Óscar Avilés por
presuntas infracciones a los artículos 18°, 19°, 38°, 56° y 152° del Código de
Protección y Defensa del Consumidor. En dicha resolución se discute si la
denunciada habría incurrido en: (i) actos de discriminación en el consumo (ii)
infracción al deber de idoneidad; (iii) infracción al deber de entregar el libro de
reclamaciones; y, (iv) haber ejercido métodos comerciales coercitivos.
La finalidad del presente informe es evaluar si es que efectivamente la
denunciada habría incurrido en alguna de las infracciones antes señaladas. Para
ello, primero se evaluarán los derechos que están involucrados en cada tipo
infractor, ello haciendo uso la normativa aplicable, jurisprudencia y doctrina;
segundo, en base a los hechos, medios probatorios presentados y con apoyo del
marco teórico previamente establecido, se hará un análisis de cada supuesto
infractor en específico y se determinará si es que la Sala Especializada en
Protección al Consumidor hizo un correcto análisis de los mismos.
Finalmente, en base al análisis realizado se concluirá que la denunciada no
habría cometido actos de discriminación en el consumo ni habría ejercido algún
método comercial coercitivo; sin embargo, sí cometió en una infracción a la
obligación de entregar el Libro de Reclamaciones; y la conducta imputada como
infracción al deber de idoneidad en realidad es una infracción al artículo 150° del
Código.
This legal report will analyze the Resolution N° 3206-2023/SPC-INDECOPI, which resolves the denouncement filed by Mrs. Elizabeth Magaly D'Uniam Paredes against the Cultural Association Óscar Avilés for alleged violations to articles 18°, 19°, 38°, 56° and 152° of the Consumer Protection and Defense Code. In said resolution it is discussed whether the accused has incurred in: (i) acts of discrimination in consumption; (ii) violation of the duty of suitability; (iii) violation of the duty to deliver the complaints book; and, (iv) having exercised coercive commercial methods. The purpose of this report is to evaluate whether or not the accused has actually incurred in any of the aforementioned infringements. For this purpose, it will be evaluated the rights involved in each type of infringement, making use of the applicable regulations, jurisprudence and doctrine; second, based on the facts and evidence presented, as well as with the support of the theoretical framework previously established, an analysis of each specific infringement will be made and it will be determined if the authority made a correct analysis of them. Finally, based on the analysis carried out, it will be concluded that the accused did not commit acts of discrimination in the consumption nor did it use any coercive commercial method; however, it did infringe the obligation to deliver the complaints book; and the conduct alleged as an infringement of the duty of suitability is in fact an infringement of Article 150°of the Code.
