Abstract
El objetivo del presente informe será presentar un análisis sobre el
pronunciamiento de la Corte Interamericana de Derechos Humanos en el caso
Vicky Hernandez y otras vs. Honduras, cuya relevancia radica en ser la primera
ocasión en la que la Corte aplica la Convención Belém Do Pará en relación a la
salvaguardia de los derechos de las mujeres trans. Así, la Corte IDH declaró la
responsabilidad de Honduras por la violación de los artículos 7.a y 7.b de la
CBDP. Con esta finalidad, se hará un análisis de la evolución del concepto
“género” en el Derecho Internacional de los Derechos Humanos. Además, se
hará referencia al voto disidente de la jueza Odio Benito, para evidenciar la falta
de aplicación de un enfoque interseccional que tenga en consideración el
derecho a la identidad de género de la víctima. En esa misma línea, se hará
referencia al voto del magistrado Vio Grossi para plantear la necesidad del uso
de la interpretación dinámica o evolutiva de los artículos 7.a y 7.b de la
Convención Belém do Pará, de manera que se incluya a las mujeres trans dentro
de su ámbito de protección. Finalmente, se analizará la línea jurisprudencial
sobre la cual la Corte Interamericana de Derechos Humanos ha identificado
estereotipos de género en el análisis de la debida diligencia para plantear si es
posible determinar que, es suficiente detectar la presencia de estereotipos en
una investigación para concluir que no hubo debida diligencia.
The objective of this report will be to present an analysis of the pronouncement of the Inter-American Court of Human Rights in the case of Vicky Hernandez vs. Honduras, whose relevance lies in being the first time that the Court applies the Belém Do Pará Convention in relation to the safeguarding of the rights of trans women. The Inter-American Court declared the responsibility of Honduras for the violation of articles 7.a and 7.b of the CBDP. For this purpose, an analysis of the evolution of the concept "gender" in International Human Rights Law will be made. In addition, reference will be made to the dissenting vote of Judge Odio Benito, to demonstrate the lack of application of an intersectional approach that takes into account the right to gender identity of the victim. Along the same lines, reference will be made to the vote of magistrate Vio Grossi to raise the need to use the dynamic or evolutionary interpretation of articles 7.a and 7.b of the Belém do Pará Convention, so that trans women are included within its scope of protection. Finally, the jurisprudential line on which the Inter-American Court of Human Rights has identified gender stereotypes in the due diligence analysis will be formulated to consider whether it is possible to determine that it is enough to detect the presence of stereotypes in an investigation to conclude that there was no due diligence.
