Abstract
En el presente informe jurídico se abordan cuatro problemas jurídicos
identificados en el marco de una proceso de habeas corpus en el cual se
cuestionó la medida peruana de exigir, únicamente, a las personas de
nacionalidad venezolana, contar con pasaporte visado para poder ingresar al
territorio peruano. En tal sentido, la resolución N° 00688-2020-PHC/TC
representa un gran avance en la evolución normativa y sobre todo jurisprudencial
del derecho migratorio en el Perú. No obstante, en el desarrollo del informe se
aborda los contenidos sobre las materias que debían ser resueltas en el caso y
se realizan críticas al respecto.
This legal report addresses four legal problems identified in the context of a habeas corpus proceeding in which the Peruvian measure of requiring only Venezuelan nationals to have a visa in order to enter Peruvian territory was challenged. In this sense, Resolution No. 00688-2020-PHC/TC represents a great advance in the normative and, above all, jurisprudential evolution of immigration law in Peru. However, in the development of the report, the contents of the matters that should have been resolved in the case are addressed and criticisms are made in this regard.
