Informe jurídico sobre la Resolución N°. 0430-2025-SUNARP-TR

Abstract

En el marco regulatorio del Derecho Administrativo, existe una figura que ha sido extendida en sede registral desde hace más de una década: la inhibitoria administrativa. Esta figura busca evitar algún potencial conflicto de competencias a raíz de respuestas discordantes tanto por un órgano administrativo como judicial. Mediante el presente Informe Jurídico, se analiza la Resolución N°. 0430-2025- SUNARP-TR, a partir del cual se formula inhibitoria administrativa registral tras una solicitud de inhibición presentada por un particular al Registro. Asimismo, se analiza la decisión de la existencia de la triple identidad de sujetos, hechos y fundamentos entre el procedimiento registral y el proceso judicial, la misma que conllevó a paralizar la función registral. En el presente Informe pretendemos cuestionar y establecer que la inhibitoria administrativa registral es contraria a la naturaleza especial y no contenciosa del procedimiento registral, puesto que no solo vulnera diversos principios elementales del sistema registral, sino que además paraliza la función registral por el simple conocimiento extra registral de un litigio. Para ello, se abordarán los contornos conceptuales de la inhibición, la naturaleza del procedimiento registral y las implicancias en el marco regulatorio procesal actual. Ello con un claro objetivo: sostener que la inhibitoria administrativa no debe ser pasible de extensión en sede registral.

In the regulatory framework of Administrative Law, there is a figure that has been extended in the registry for more than a decade: the administrative inhibitory. This figure seeks to avoid any potential conflict of competences as a result of discordant responses by both an administrative and judicial body. This Legal Report analyzes Resolution N°. 0430-2025-SUNARP-TR, which formulates an administrative inhibitory administrative registration proceeding following a request for inhibition filed by an individual to the Registry and the consequent decision of the existence of the triple identity of subjects, facts and grounds of the registration proceeding and the judicial process that paralyzed the registration proceeding. In this Report we intend to question and establish that the administrative inhibition of the registry is contrary to the special and non-contentious nature of the registry procedure, since it not only violates several elementary principles of the registry system, but also paralyzes the registry function by the simple extra-registry knowledge of a litigation. To this end, the conceptual contours of the inhibition, the nature of the registry procedure and the implications in the current procedural regulatory framework will be addressed. The objective is clear: to argue that the administrative inhibition should not be subject to extension in the registry.
