Con este trabajo de investigación se pretende poner en evidencia el uso
excesivo e injustificado de la contratación directa; es decir, el abuso de la
contratación directa, durante pandemia, el cual ha vulnerado el principio de
libre concurrencia, competencia y transparencia que debe regir las
contrataciones del estado. Puesto que, algunas entidades estatales amparadas
en la normativa vigente, que las faculta a realizar contrataciones directas, a
razón de la emergencia sanitaria, han adquirido bienes mediante
contrataciones directa, cuando no correspondía usar dicho método de
contratación; debido a ello, se busca hacer notar que no es un problema de
falta de regulación normativa, sino de inobservancia de las mismas, que viene
amparándose en una falta de control y/o fiscalización de las contrataciones
directas. Como principales conclusiones del trabajo de investigación son:
advertir que diversas entidades estatales han usado indebidamente la
contratación directa; confirmar si los principios de libre concurrencia y
transparencia se aplican a las contrataciones directas; asimismo demostrar el
uso indebido de la contratación directa vulnera el principio de libre competencia
concurrencia y transparencia; se pretende demostrar que se requiere un
adecuado control de las contrataciones directas; por último, señalar propuestas
de mejora para superar las deficiencias en las contrataciones directas.
The purpose of this research work is to highlight the excessive and unjustified use of direct contracting; that is, the abuse of direct contracting during the pandemic, which has violated the principle of free competition, competition and transparency that should govern state contracting. Since, some state entities, protected by the regulations in force, which empower them to make direct contracting, due to the sanitary emergency, have acquired goods through direct contracting, when it was not appropriate to use such contracting method; due to this, it is intended to point out that it is not a problem of lack of normative regulation, but of non-observance of the same, which is covered by a lack of control and/or supervision of direct contracting. The main conclusions of the research work are: to warn that several state entities have improperly used direct contracting; to confirm whether the principles of free competition and transparency apply to direct contracting; to demonstrate that the improper use of direct contracting violates the principle of free competition, competition and transparency; to show that an adequate control of direct contracting is required; and finally, to point out proposals for improvement to overcome the deficiencies in direct contracting.
