Efectos jurídicos perjudiciales recaídos en el tercero registral como consecuencia del asiento cancelatorio, extendido de acuerdo al artículo 5 de la Ley 30313

Resumen
La constante evolución de herramientas, de las que se valen las organizaciones delictivas para
defraudar a los propietarios de bienes inmuebles, en los últimos años ha impactado de manera
significativa en la seguridad jurídica y en la efectiva protección del derecho de propiedad.
La respuesta del Estado a esta problemática se dio mediante la promulgación de la Ley
Nº 30313, que fue materia de diversos cuestionamientos, uno de ellos recae en lo señalado por
el artículo 5º: La información contenida en las inscripciones y anotaciones preventivas que
han sido canceladas, no perjudica al tercero en los términos establecidos en el artículo 2014
del Código Civil (…). El objetivo general del trabajo fue demostrar que esta supuesta
indemnidad jurídica no se cumple, y que el tercero registral sí se encuentra afectado por el
asiento cancelatorio. Para tal fin se revisó el procedimiento de cancelación administrativa en
sede registral por los supuestos de falsificación documentaria o suplantación de identidad
contrastando con lo establecido por la doctrina nacional y extranjera respecto a los principios
rectores del sistema registral los cuales se han visto modificados por la normativa referida, por
lo que se concluye que efectivamente desde la norma, el asiento cancelatorio, produce una
afectación real al derecho del tercero registral.
The constant evolution of tools, which criminal organizations use to defraud property owners, in recent years has had a significant impact on legal security and the effective protection of property rights. The State's response to this problem was given through the enactment of Law No. 30313, which was the subject of various questions, one of them falls on what was pointed out by: The information contained in the inscriptions and preventive annotations that have been canceled does not harm the outsider in the terms established in article 2014 of the Civil Code (…). The general objective of the work was to demonstrate that this supposed legal indemnity is not fulfilled, and that the outsider registry is affected by the cancellation entry. To this end, the administrative cancellation procedure at the registry office was reviewed for cases of documentary falsification or identity theft, contrasting with what is established by national and foreign doctrine regarding the governing principles of the registry system, which have been modified by the regulations. Referred, for which it is concluded that effectively from the norm, the cancellation entry, produces a real affectation to the right of the third party registry.
