Resumen
En el mercado, existen proveedores que ofrecen distintos servicios como productos, quienes
tienen la obligación de otorgarle a los consumidores toda la información que sea considerada
como relevante del producto ofertado, ello con la finalidad de que dicho consumidor, en base
a sus propios intereses, realice una acertada decisión de consumo. Ahora bien, en relación a las
agencias de viajes surge una controversia sobre el alcance de este deber de información con
respecto a qué debería considerarse como información relevante. Como evidencia de lo
mencionado, en la Resolución N° 435-2016/SPC-INDECOPI se llegó a la conclusión de que
no era obligación de Viajes Falabella S.A.C., quien actuó como una agencia de viajes minorista,
remitirle al consumidor de forma oportuna a cuánto ascendía el costo total de las penalidades
causadas por reprogramar los boletos aéreos y el tour contratado. En tal sentido, el presente
informe jurídico tiene como finalidad demostrar que en base a la normativa sectorial, tanto
nacional como supranacional, que existe en nuestro ordenamiento jurídico sobre el servicio de
transporte aéreo, las penalidades por reprogramación sí constituyen información relevante que
debió ser remitida de manera oportuna al consumidor, pues dicha información influye en la
creación de la relación de consumo.
In the market, there are suppliers that offer different services such as products, who have the obligation to provide consumers with all the information that is considered relevant to the product offered, in order for that consumer, based on their own interests, make an informed consumer decision. However, in the case of travel agencies, a controversy arises about the scope of this information duty with respect to what should be considered as relevant information. As evidence of this, Resolution N° 435-2016/SPC-INDECOPI concluded that it was not the obligation of Viajes Falabella S.A.C., which acted as a retail travel agency, to remit to the consumer in a timely manner how much was the total cost of the penalties caused by rescheduling the air tickets and the contracted tour. In this sense, this legal report has the objective of demonstrate that based on the sectoral regulations, both national and supranational, that exist in our legal system on the air transport service, the penalties for rescheduling do constitute relevant information that should have been sent to the consumer in a timely manner, since that information influences the creation of the consumer relationship.
